Terms and Conditions

Last updated: November 1, 2025

1. Scope

These General Terms and Conditions apply to all orders placed on www.boutiqa.ch as well as to the use of our website. By submitting an order or using our services, you agree to these terms.

2. Provider

BOUTIQA Switzerland
For questions, you can reach us at info@boutiqa.ch. Our registered office is located in 5303 Würenlingen, Canton Aargau, Switzerland.

3. Conclusion of contract

Product representations are non-binding. A contract is only concluded upon our shipping confirmation. We may refuse orders without giving reasons (e.g., supply shortages, suspicion of misuse).

4. Prices, taxes & payment

All prices are in CHF. Errors in price and typos excepted. Any bank/transaction fees shall be borne by the customer. For deliveries outside of Switzerland, customs duties/import taxes may apply; these shall be borne by the recipient.

5. Shipping, delivery time & risk

Processing: 1–3 business days after receipt of payment.
Delivery time: 5–10 business days (guideline).
Sale/promotional items: may take longer (external warehouses/high demand).
All delivery times are non-binding. Delays due to logistics, customs, or force majeure do not entitle the customer to compensation. Upon handover to the shipping service provider, the risk passes to the customer within the framework of statutory provisions. Incorrect/incomplete addresses or refusal of acceptance result in additional costs, which shall be borne by the customer.

6. Customs & import

For international shipments, the import regulations of the recipient country apply. Customs duties/taxes/fees shall be borne by the recipient. We have no influence on customs processing times.

7. Product representations & availability

Colors, measurements, and details may vary slightly depending on the screen/batch. Availability is subject to change; in the event of unavailability, we will inform you and, if applicable, refund the purchase price.

8. Changing/canceling an order

Orders are processed quickly; therefore, changes/cancellations after order receipt are generally not possible. Once shipped, the return policy (Section 10) applies. If acceptance is refused, we may deduct a restocking fee and our shipping costs.

9. Vouchers & discounts

Vouchers/discount codes cannot be paid out, cannot be combined (unless otherwise stated), and may be subject to expiration. In the event of returns, the voucher value will not be refunded; any potential refund will be reduced by the voucher portion.

10. Returns, exchanges & defects

There is no statutory right of withdrawal in Switzerland. As a courtesy, we offer:

  • Exchange or credit note within 14 days of receipt,

  • Items must be unworn, unused, in original packaging,

  • Prior notification via email to info@boutiqa.ch

  • Return shipping costs are borne by the customer (except in the case of a proven defect/incorrect delivery).
Sale/discounted items are excluded from exchange (except in the case of defects).
In the case of defects, please send us photos + description; at our discretion, we will provide a replacement, repair, or credit note.

11. Warranty

The statutory warranty applies according to the Swiss Code of Obligations (OR) (2 years for new goods). Excluded are normal wear and tear, improper use/care/storage, and unauthorized modifications/repairs. Further claims are limited according to Section 12.

12. Liability

Further liability exists only to the extent mandatory by law. Otherwise, liability is limited—as far as legally permissible—to the purchase price of the affected item; indirect damages/consequential damages/loss of profit are excluded.

13. Retention of title

The goods remain our property until full payment is received. In the event of payment default, we are entitled to assign claims.

14. Website usage (Acceptable Use)

The website must not be used improperly (e.g., disruption, scraping, automated requests, distribution of malware, illegal content). We may block access if there is reasonable cause.

15. Intellectual property

All content (texts, images, layout, brands/logos) is protected. Use is for personal, non-commercial use only. Any further use requires our consent.

16. Links & third-party content

External links are for informational purposes; we are not liable for their content/availability. Links to our site are only permitted in a fair, lawful manner without damage to our reputation.

17. IT security & viruses

We do not guarantee that the site will be free of errors or viruses at all times. Use your own security measures. Introducing malicious software is prohibited.

18. Indemnity

You indemnify us against third-party claims arising from unlawful use of the website or your breach of contract (to the extent legally permissible).

19. Force majeure

In the event of incidents such as natural disasters, strikes, government orders, network/platform outages, or comparable circumstances beyond our control, service disruptions are not our responsibility. If the situation lasts longer than 14 days, both parties may terminate the contract regarding the affected order; amounts already paid will be refunded pro-rata.

20. Customer account & communication

You are responsible for the confidentiality of your access data. Contractual notifications may be sent electronically (email).

21. Amendments to the GTC

We may adapt these GTC; the version published at the time of the order is authoritative. Changes will be published on the website and are effective upon publication.

22. Assignment

Rights and obligations from the contract may not be assigned without our consent. We may assign rights/obligations to affiliated companies/service providers, provided your legitimate interests are protected.

23. Severability clause & waiver

If a provision is invalid, the remainder remains effective; the invalid provision shall be replaced by the statutory regulation. Failure to enforce a right does not constitute a waiver for the future.

24. Priority & language

In the event of contradictions, these GTC take precedence over specific shop notices, unless expressly stated otherwise. The German-language version is authoritative.

25. Applicable law & jurisdiction

Swiss law applies (excluding the UN Sales Convention). The place of jurisdiction is the registered office of BOUTIQA Switzerland (Canton Aargau).
